You might go to the Library of Congress' Web site (they are the U.S.
CopyrightOffice), where you can read what U.S. copyright law says in
non-legalese.

Even if a book or recording is out of print, the copyright isn't
automatically lapsed.  An individual may make a copy for his own use, but
not (legally) for others.
