Yes, Brian, any establishment, including stores, restaurants, bars,
taverns, nightclubs, dance halls, etc., etc., etc. are required by law to
pay appropriate royalties for whatever types of recorded music they are
using. In fact, ASCAP here in NYC has an entire department devoted to
dealing with this type of music, setting up fees and attempts to collect.
You may have thought this a joke, my friend, but it certainly is not,
especially to the songwriters, composers, instrumentalists, recording
engineers, studio musicians and everyone else that makes a living from
this type of venture.
When in doubt, send in the money! Call! Write! Telegram! ASCAP is more
than happy to send out fee schedules and other particulars regarding any
type of recorded music for use in a public establishment.
