[HANASHIR:4191] Re: recording copyright question



Dear Susan and anyone else who will be recording soon,
    Two summers ago, in my capacity as Rosh Shira at Camp Ramah N.E., I 
recorded an album with the campers of both popular Israeli music and liturgy. 
 Needless to say, I did not have the time or energy to track down Yair Dalal, 
Achinoam Nini, David Broza...(you get the idea).  I went to the camp's Lawyer 
and was advised that: 1) As long as the songs were credited,  2) A disclaimer 
was included that the CD was for educational use only and was NOT FOR SALE, 
and 3) all duplication and sale was prohibited unless permission was received 
from RAMAH (Something that we obviously would not give), there were no 
copyright issues.  (From which profit could royalties could be paid?)   

Here is the exact text I used in the CD Literature:
    Camp Ramah wishes to thank the composers and arrangers of these songs for 
sharing their music on this album.   We apologize for any errors in 
songwriting credit or any inadvertent omissions.  All songs are copyrighted 
by and remain the property of the original composers.

    This album is a gift of Camp Ramah in New England to its campers and 
staff.  Neither it nor any of its accompanying materials may be duplicated, 
sold, or otherwise used for monetary gain without expressed written 
permission from Camp Ramah in New England.

    

    I hope this information will be helpful to those of you getting into the 
exciting world of recording.  If you have any more questions, please don't 
hesitate to ask.
