As a person who neither writes music nor records it, I would think that at 
least attempting to get permission for a piece is not only the "moral and 
ethical" thing to do, but also a nice courtesy so that the composer can have an 
idea of how their music is being used.  It seems like it would also be a 
compliment to the composer.  As Erik said, I'd guess many composers would be 
happy to give their consent.

  just fyi, just because someone prints "for educational
  use only" or just because you give a cd away and say
  that your gift is for a non-profit organization does
  NOT exempt one from the present copyright laws. if
  you're going to mass produce ANY composition by a
  composer whose copyright is still good and not in the
  public domain, you are obligated to get permission to
  record the composition.

  of course, in the real world here, it is most unlikely
  that any of the folk you'll be recording will either
  (a) never find out about your recording or (b) never
  take you to task for it. HOWEVER, in the spirit of
  derekh eretz and making jewish/religious recordings, a
  better effort should probably be made (imho) than,
  "well, i won't get caught."

  you'd also be surprised how many people who hold the
  copyrights, when asked in the right way, are more than
  willing to give permission.

  there should be a record label out there called,
  "Kosher Productions" which help recording artists
  secure recording rights more easily--then, you'll have
  a "Kosher" cd. any takers??
