I had some models from others before I negotiated my first one, but they
weren't particularly useful. The temple will almost certainly offer you its
contract which will have paragraphs to handle things that previous Cantors
did or didn't do, and it's up to you to see the pitfalls or ask for what you
want if it isn't there. I'd be happy to take a look at what they give you
(you can certainly white-out the numbers) and give you my .02. Here's what I
signed for 99-00.

CANTORIAL AGREEMENT
This AGREEMENT made and entered into this first day of May 1999 by and
between
the SYNAGOGUE and the CANTOR.
1) EMPLOYMENT: The SYNAGOGUE agrees to employ the CANTOR and the CANTOR
agrees to
accept the position as CANTOR of the SYNAGOGUE according to the terms
and conditions below
for a period of 15 months beginning May 1, 1999, and ending July 31,
2000.
2) EMPLOYMENT CATEGORY: The CANTOR shall have the status of a part-time
employee and
will be treated as such for payroll and tax purposes. The CANTOR shall
be paid as part of the reg-
ular payroll of the SYNAGOGUE.
3) DUTIES: The CANTOR is a religious leader of the SYNAGOGUE who leads
the congregation in
prayer and shall officiate at all religious rites and services together
with the rabbi. The CANTOR,
in CONSULTATION with the rabbi, shall also serve the religious,
pastoral, cultural and educational
needs of the congregation as stated below and determined by the
appropriate committees. CON-
SULTATION shall hereinafter mean that lay leadership has the ultimate
decision making authority
except over halachic matters.
4) MUSIC: The CANTOR shall be the authority on liturgical chant of the
SYNAGOGUE and all ar-
eas of Jewish music. The CANTOR, in CONSULTATION with the appropriate
committees, shall
decide upon all Jewish music programs of the SYNAGOGUE. This includes
organizing a choir and
musicians for the High Holy Days and for other occasions as required.
5) PROGRAM PARTICIPATION: The CANTOR shall be present at, and
participate in, Yom Tov and
Shabbat dinners and programs. The CANTOR shall also plan and conduct
special holiday programs
in CONSULTATION with the Ritual and Education committees.
6) MUSIC PROGRAMS: The CANTOR shall plan and teach music weekly in the
religious school,
unless the Education Committee decides otherwise. The CANTOR shall plan
and teach music
weekly in the nursery school, unless the Nursery School Director, the
Education Committee and
the Personnel Committee decide otherwise.
7) BAR AND BAT MITZVAH: The CANTOR shall assist the rabbi as requested
in teaching Bar and
Bat Mitzvah candidates.
8) COMMITTEE PARTICIPATION: Upon special request, the CANTOR shall
attend meetings of the
Ritual Committee and also participate in the work of other SYNAGOGUE
committees that deal
with the various areas of the CANTOR'S service and responsibilities to
the SYNAGOGUE, in order
that the CANTOR may contribute expertise and special competence.
9) FUND RAISING CONCERT: The CANTOR will organize one fund raising
concert in CONSULTA-
TION with the Executive Board of the SYNAGOGUE and shall submit, 3
months in advance, a
budget for approval detailing the expected income and expenses to the
Fund-raising Committee.
10) CHOIRS: The CANTOR will organize, train and prepare:
a) a Choir and accompaniment for High Holy Day Services
b) an adult member Choir for performances during the year
c) a children's Choir or singing group
11) BUDGET : All of the CANTOR'S activities under this AGREEMENT shall
be in compliance with
appropriate budgets submitted to and approved by the appropriate
committee and the Board of
Directors of the SYNAGOGUE, except as specifically provided for in this
contract.
12) COMPENSATION: The CANTORFFS total compensation package shall be $
for the
term of this contract. The CANTOR shall be responsible for filing a
claim with the IRS for parso-
nage allowance taken. The SYNAGOGUE shall cooperate by issuing the
amount of parsonage
requested on the proper forms but shall in no way be held accountable
to the IRS in this matter.
The SYNAGOGUE makes no representation concerning the tax consequences
of any such alloca-
tion.
13) PAID TIME OFF: The CANTOR shall be entitled to accrue 1 day of paid
time off for each
month of service. Absent an emergency, the CANTOR shall give as much
advance notice as pos-
sible to the SYNAGOGUE for time off; such request is subject to
approval by the Executive Board.
No compensation for unused time off shall accrue and/or be paid except
as required by California
law.
14) SEVERANCE: No Severance Pay shall accrue during the term of this
agreement, nor shall the
term of this contract count toward time served in any future
calculation of Severance Pay.
15) ABSENT COVERAGE: On any occasions in which the CANTOR plans to be
absent, he should
make provisions for coverage. The SYNAGOGUE shall be responsible for
the cost of such cover-
age when the CANTOR'S absence is covered as paid time off; otherwise,
the CANTOR shall be
responsible for the cost of coverage.
16) DISABILITY: The SYNAGOGUE will not provide the CANTOR any
disability benefits. If the
CANTOR misses 5 days of work over and above the 15 days of paid time
off, the SYNAGOGUE,
may at its option, terminate this contract.
17) ARBITRATION: Both parties agree to submit any disputes that arise
under the terms of this
AGREEMENT to arbitration through the Committee on Congregational
Standards of the United
Synagogue of Conservative Judaism. The CANTOR has the right to
representation at such Arbi-
tration. The outcome of such arbitration is to be binding on both
parties.
18) TERMINATION: The CANTOR'S services may be terminated by the
SYNAGOGUE at any time
FOR CAUSE. Upon termination FOR CAUSE, the CANTOR shall be entitled to
1/2 month's BASE
SALARY. The term FOR CAUSE as set forth in this AGREEMENT, includes,
but is not limited to,
breach of any of the terms of this AGREEMENT, or conduct unbecoming of
a CANTOR.
19) LEGAL COUNSEL: The CANTOR shall have the right to obtain, at his
own expense, legal and
Cantorial counsel of his personal choice at all times, without
prejudice or pressure, relating to any
matter connected with engagement, termination, or any other matter
contained within this
AGREEMENT, without limitation. The CANTOR represents that he has
consulted with independent
legal and Cantorial counsel in connection with this AGREEMENT to the
extent desired by him and
to his complete satisfaction. Should any dispute arise out of the
interpretation of this AGREE-
MENT, it is understood and agreed that all parties participated in the
drafting of this AGREEMENT.
20) INTEGRATION/MODIFICATION: This AGREEMENT contains all the terms and
conditions of
engagement and no changes in this AGREEMENT shall be binding in either
party unless agreed by
both parties in writing and is subject to approval by the Board of
Directors of the SYNAGOGUE, if
necessary.
21) INCORPORATION: The publication entitled, A Guide to Congregational
Standards, of the Unit-
ed Synagogue of Conservative Judaism, as may be amended from time to
time, is incorporated
into this AGREEMENT by this specific reference. In all other respects
this AGREEMENT shall be
interpreted and enforced according to the traditions and practices of
the United Synagogue of
Conservative Judaism. However, to the extent that A Guide to
Congregational Standards of the
United Synagogue of Conservative Judaism is in conflict with any
provisions contained in this
AGREEMENT, the terms of this AGREEMENT shall prevail.
